Assessment task 2: Case Analysis

Locate, read and do a case analysis on Trident General Insurance Co Ltd v McNiece Bros Pty Ltd based on the High Court judgment and provide the following information:

case citation

brief statement of material facts

brief history of the proceedings.

full names of the parties in the case at the court of first instance and appellate courts

name of the trial and appellate judge

grounds of appeal and or issues to be decided

decisions made by the court

ratio decidendi

dissenting judgements

obiter dictum if any

Due date: 05/05/2017.

Weighting: 35%

Length and/or format: 2000 words

Purpose: The purpose of this assignment is to test the student’s legal research skills and to assess their understanding of case law analysis and hierarchy of courts.

Learning outcomes assessed: LO’s 1,2,3.

How to submit: Online submission using Turnitin AND hard copy to be delivered to the submission box in the Thomas More Academy of Law offices on your campus on or before the due date. Students will need to complete an electronic declaration of originality for the online submission and an Academy of Law Cover Page for the hard copy submission. A Turnitin report will automatically be made available for the online submission. Students are not required to print out and submit a copy of the Turnitin report with their hard copy submission.

Return of assignment: Assignments will be returned to students during tutorials. In accordance with the Assessment Policy, assignments will be returned within three weeks of submission.

Assessment task 3: Open Book Examination

Due date: ACU examinations period

Weighting: 40%

Length and/or format: 2 hours

Purpose: Short essay question and problems questions to test knowledge of all that has been taught during the semester.

Learning outcomes assessed: LO’s 3,4,5.

How to submit: N/A

Return of assignment: In accordance with the Assessment Policy, examination results will be provided within three weeks of exam.
